KUALA LUMPUR: Actor and model Tony Eusoff has filed a suit against Gulatis Exclusive Sdn Bhd for allegedly using his photographs for over a year on the textile company’s bunting, billboards and in newspaper advertisements.
Tony, or Anthony Joseph Hermas Rajiman, 33, jointly filed the suit with model-cum-actress Diana Johor Zainal Abidin, 29, who also appeared in the photographs used by the company for commercial purposes without their permission.
The pair are seeking RM500,000 each in general damages and exemplary damages to be determined by the court.
The suit was filed through A.R. Effande & Partners at the Registrar’s office of the High Court here yesterday.
This is the third time the company has been sued by celebrities for allegedly using their photographs for advertisement purposes without permission.
Last month, model Zahnita Dorothy Hussein Wilson filed a RM2mil suit against Gulatis for allegedly using her pictures on its posters and advertisements without her permission that resulted in her suffering huge losses when other textile companies cancelled their projects with her.
The company was also ordered last month by the High Court to pay RM20,000 in damages to actress Siti Sharizah Saifuddin, or Eja, for breach of an oral agreement on the use of her image in its posters and advertisements.
Lawyer Ahmad Rizal Effande Zainol said the legal firm had sent a notice on behalf of the plantiffs, demanding compensation from Gulatis on Feb 19, 2008.
However, he said the company failed to respond.
Tony said by using their photographs, the company had affected opportunities for them to represent other companies.
